Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. The “Back to Nature™ Cheddalicious™ Giveaway” (the “Sweepstakes”) begins at 12:00 p.m. Eastern Time (“ET”) on February 13, 2021 and ends at 11:59 p.m. ET on March 1, 2021 (“Sweepstakes Period”). Sweepstakes is sponsored by B&G Foods North America, Inc. (the “Sponsor”), 4 Gatehall Drive, Parsippany, NJ 07054.

ELIGIBILITY: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who are 18 years of age or older as of the Sweepstakes start date. Employees, officers, directors, representatives or agents of Sponsor or any of its affiliates, subsidiaries, and agencies, and members of their immediate family or persons living in the same household as such individuals are not eligible to participate in the Sweepstakes.  All federal, state, and local laws and regulations apply.  Void where prohibited.

HOW TO ENTER: NO PURCHASE NECESSARY.  During the Sweepstakes Period, eligible participants may enter the Sweepstakes by visiting https://backtonature.lpages.co/cheddalicious-giveaway/ and completing the required fields on the web entry form. The completed and submitted entry form will be one (1) entry into the Sweepstakes.  This Sweepstakes is not in any way sponsored, endorsed, administered by, or associated with, Facebook or Instagram.

 

LIMIT one (1) entry per person, per email address during the Sweepstakes Period. Proof of submission of an entry is not considered proof of delivery to or receipt by Sponsor. Sponsor’s computer is the official timekeeping device for the Sweepstakes. The Released Parties are not responsible for: (a) late, incomplete, delayed, damaged or misdirected entries; (b) causes beyond Released Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; (c) any entries submitted in a manner that is not expressly allowed under these Official Rules; (d) incorrect or inaccurate entry information; (e) any typographical or other error in the printing or advertising of the Sweepstakes, in the administration or execution of the Sweepstakes, or in the announcement/notification of the prize winner or (f) cheating or fraud by any participant. All incomplete or non-conforming entries will be disqualified. All entries become the exclusive property of Sponsor and will not be acknowledged or returned except as provided herein. By participating, entrant consents to Sponsor’s and its agent’s use of entrant’s personal information for the administration of this Sweepstakes.  In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the email address associated with the entry.  “Authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.  Entrants are prohibited from using multiple names, email addresses or other means to enter more than the permitted number of times.  Any attempt to do so is grounds for disqualification.

DRAWING AND NOTIFICATION: A random drawing to determine fifty (50) Prize winners will take place from all eligible entries received during the Sweepstakes Period on or about March 2, 2021. All drawings will be conducted by Sponsor whose decisions are final in all matters relating to the Sweepstakes. The odds of winning a prize depend on the total number of eligible entries received. The potential Prize winner will be notified by email, to be sent to the email address provided on their entry form.

PRIZE: Each Prize winner will receive one (1) case (containing twenty four (24), 1oz. pouches) of Back to Nature™ Cheddalicious™ crackers (maximum value of each case is $23.96). The Approximate Retail Value (“ARV”) of the Prize is $23.96.

PRIZE CONDITIONS: If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, if potential winner fails to return requisite documents within the specified time period, or if a potential winner is not in compliance with these Official Rules, as determined by Sponsor at Sponsor’s sole discretion, then such person shall be disqualified and an alternate winner will be selected for the Prize.  The Prize will be mailed to the winner’s physical address (P.O. boxes are not permitted).  All taxes, if applicable, are the sole responsibility of the Prize winner. The Prize winner may be required to complete and sign an Affidavit of Eligibility and Liability/Publicity Release form provided to them to be returned within seven (7) days of written notification, or prize may be forfeited and/or an alternate winner may be selected at Sponsor’s sole discretion and time permitting. The Prize may not be sold, traded, transferred, refunded, commissioned or redeemed for cash value. The Sponsor reserves the right at its sole discretion to substitute any part of the prize with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. Decisions of the Sponsor are final and binding.

PUBLICITY/USAGE RIGHTS:  Entering the Sweepstakes constitutes permission (except where prohibited) for the Sponsor to use such winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, including the Internet, for any commercial, publicity or promotional purpose, without limitation, in perpetuity, without review, notice, consideration or compensation.

INTERNET LIMITATIONS OF LIABILITY: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice.  No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, or for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes or downloading any materials in connection with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating the Official Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes; and/or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT, TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute waiver of that provision.  By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules.

USE OF DATA: Sponsor will be collecting personal data about entrants in accordance with its Privacy Policy. Please review the Sponsor’s Privacy Policy that can be found on their website, https://www.bgfoods.com/privacy-policy. By participating in the Sweepstakes and providing this information, entrants hereby (a) agree to Sponsor’s collection and usage of their personal information, (b) acknowledge that they have read and accept Sponsor’s Privacy Policy, and (c) grant to Sponsor, the right to use his/her name, mailing address, telephone number, and e-mail address for the purpose of administering the Sweepstakes, including but not limited to contacting and announcing the winner and fulfilling the Prize.

TERMS & CONDITIONS/LIABILITY & RELEASE: This Sweepstakes is subject to all applicable federal, state, and local laws. By entering the Sweepstakes, where permitted by law, entrants agree to release, discharge, indemnify, and hold harmless Sponsor, Facebook, Instagram, and each of their respective shareholders, administrators, legal representatives, directors, officers, employees, agencies, agents, representatives, parent companies, subsidiaries, divisions, affiliated and related companies, predecessors, successors and assigns (collectively, the “Released Parties”), from and against any and all liability, loss, claim, damages, cause of action arising out of participation in the Sweepstakes or receipt or use, misuse or possession of any prize, including, but not limited to: (a) injuries to any person (including death) or property of any kind (including computers or mobile devices) sustained in connection with entrant’s participation in the Sweepstakes or from their acceptance, receipt, possession, and/or use or misuse of the prize, (b) any typographical or other error in the printing, offering, or announcement of the prize, (c) human error or unauthorized human intervention in the Sweepstakes, (d) technical errors related to computers, mobile devices, servers, providers, or telephone or network lines, (e) lost, late, misdirected, illegible, garbled, or damaged entries, or (f) errors in the administration of the Sweepstakes or the processing of entries. Entrants further acknowledge that the Released Parties have neither made, nor are in any manner responsible or liable for any warranty, representation, or guarantee express or implied, in fact or in law, relating to the Prize, including, but not limited to, its quality or fitness for a particular purpose. This Sweepstakes is void where prohibited.

DISPUTES: Except where prohibited, each entrant further agrees that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees, (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses, and (d) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey, and shall be resolved exclusively in the state or federal courts in the State of New Jersey, and each entrant expressly consents to the jurisdiction of said courts and waives any objection thereto.
